We are MyPobal.com and we would like to welcome you to our wholly owned and operated Canadian site. We would like to take the time to outline the following terms, which we have put in place so that your experience on our site is positive.
At MyPobal.com we do not condone or tolerate any use of our site that may be considered illegal or go against any of our policies. We may further to this notification take steps to limit a user’s ability to access our site if there action goes against our policies or is considered illegal. There is a system in place for users to report abusers of our site and we recommend doing so if you feel something is offensive or you are experiencing problems with other users. Though such circumstances may occur we do not accept any liability for monitoring MyPobal.com or for unlawful or unrestricted content on MyPobal.com by users of this site.
Users of MyPobal.com will post their goods, services or businesses in the designated category or area and will agree to not do anything listed below.
-infringe on third parties rights, distribute spam, viruses or any other technology that may cause harm to the operation of our site or its users, advertise or list pyramid schemes on our site, violate any of the laws outlined in Unlawful or Restricted Content Policy, use any automated devices or systems to access MyPobal.com for the purpose of collecting content without express written consent, bypass any systems in place used to prevent or limit access to MyPobal.com, collect or store information about others without their consent, be false or misleading, cause a load to our system or site that would be considered harmful or restricting to its proper function, modify or redistribute the content of another user.
Business and Services Users of MyPobal.com including those who have a profile on our site and in the operation of their businesses do provide, supply, or sell goods deemed to be retail items must not list these goods in our classifieds section. This section is for after retail items only. New retail must be listed on your profile in the services section. (After Retail) refers to goods that have been pre owned or purchased at retail level previously. Any user of our services section who is found in breach of these terms may have their profile and listing removed permanently.
Fees and Services we Charge depending on how you use MyPobal.com there may be a fee charged. We are a free listing site but do offer option for users to upgrade their listing to make it more visible by way of a paid fee. We will only charge such fees with the users consent and this fee will be quoted in Canadian Currency. These fees may change as our site does and we will post notification of these changes on our site so our users are fully aware. Any fees paid are non refundable and the user is responsible for paying them when due. Any breach of this condition may affect the user’s ability to use our site. Any payments that are not honoured are may be collected through other third party companies.
Content you the user agree not to copy, modify, or redistribute MyPobal.com or infringe on our copyrights or trademarks. You are granting us non-exclusive, worldwide, perpetual irrevocable, royalty free, sub licensed right to exercise the copyright, publicity, and database right to that content when you give us content. If you feel these rights have been infringed upon please contact our customer support center so we can investigate. We reserve the right to remove any content that is deemed to be infringing on other parties rights regarding these issues. Please note we can only list your content on our sight by way of these rights.
Intellectual Property Infringement users of MyPobal.com will not post content that infringes on the rights or third parties. This includes but is not limited to, content that infringes on the intellectual property rights of copyright or trademarks. This includes any items considered to be counterfeit. MyPobal.com reserves the right to remove any content we believe to be in violation of these terms, our policies or third party’s rights.
If you believe that the above terms, or a third parties intellectual rights have been infringed on please notify us through our customer support center. Only parties with ownership issues as pertaining to these infringements should file such claims. We will investigate on your behalf and work to resolve this issue with the owner of the rights.
Liability Users of MyPobal.com agree to not hold us responsible for other user’s actions or posts. We cannot guarantee that posting by other users on our site are accurate, safe, or legal. MyPobal.com also cannot guarantee that access to our site will be secure or available at all times. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations, conditions, expressed written or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. MyPobal.com is not liable for any loss whether of money including profit, goodwill, or reputation, or any special indirect or consequential damages arising out of your use of MyPobal.com, even if you advise us or we could reasonably foresee the possibility of such damages occurring. Some Jurisdictions do not allow the disclaimer of warranties or exclusion of damages occurring. Some jurisdictions do not allow disclaimer of warranties or exclusion of damages, so such disclaimers and exclusion may not apply to you.
Despite this if we are found liable our liability to you or any other third party whether in contract, or tort, by statute or otherwise are limited to the greater of the fees you pay to use in 12 months prior to the action giving rise to liability and 100 Canadian Dollars.
